Nater Dallafior enforces a covenant not to compete against the former director of a leading European housewares manufacturer in arbitral proceedings under Swiss rules.
A leading European housewares manufacturer brought a claim against its former director of design for breaching its obligations not to compete. The defendant was found to have designed a logo for a direct competitor of our client based in Asia. Pleading the nullity of the covenant not to compete, the defendant denied any wrongdoing. A panel of three arbitrators ruled in favour of our client and found that the former director was in breach with its obligations. It awarded our client damages. The Nater Dallafior team included Mathis Berger and Roland Bachmann.
