Nater Dallafior enforces a covenant not to compete against the former director of a leading European housewares manufacturer in arbitral proceedings under Swiss rules.
A leading European housewares manufacturer brought a claim against its former director of design for breaching its obligations not to compete. The defendant was found to have designed a logo for a direct competitor of our client based in Asia. Pleading the nullity of the covenant not to compete, the defendant denied any wrongdoing. A panel of three arbitrators ruled in favour of our client and found that the former director was in breach with its obligations. It awarded our client damages.
