Nater Dallafior successfully represents a major European supplier of maintenance services for trains in challenging a decision awarding the contract in public procurement proceedings

Following ordinary public procurement proceedings, a transportation company awarded a contract to provide maintenance services for trains to a competitor of our client. Upon appeal filed against the decision, the appeal authority of Berne annulled the decision. The authority followed our reasoning and held in particular that the transportation company violated the principles of transparency and equal treatment of the competitors when assessing the offers of the competitors with regard to pricing. The Nater Dallafior team included Roberto Dallafior and Martin Rauber.
